Bid Confidentiality and Process Integrity
To maintain a fair and ethical bidding process, all submitted bids are considered confidential. Bid amounts and proposal details cannot and will not be shared with other potential vendors. Any vendor who receives or uses another vendor’s bid information, or any person who shares that information with a competing vendor, is subject to immediate disqualification from consideration. This policy protects both the Association and all vendors who participate in good faith.
Bidding Requirements
Per the Ohio Revised Code governing planned communities, the Board is not required to seek competitive bids for service contracts. While the Board does choose to solicit bids as a best practice for major contracts, it is not statutorily mandated to do so.
Additionally, the Board is not required to accept the lowest bid. The Board’s fiduciary duty is to select the proposal that is most beneficial to the organization. This includes consideration of price, but also scope of work, reliability, insurance, equipment, references, past performance, responsiveness, and the ability to service our entire property.
The Board has the discretion to make that exact type of business judgment when it determines that value and service outweigh a lower price.
